The European Commission announced on the 7th that, due to a "price commitment" agreement with China, some Chinese photovoltaic (PV) companies will be exempt from high anti-dumping duties. However, the countervailing investigation into solar cells and related components produced in China will continue. The EU has decided not to implement temporary taxation measures for now, and the final results of the investigation are expected to be released by the end of the year.
On the same day, the Commission confirmed it would not impose temporary countervailing duties on Chinese solar cell products. However, the final decision on whether to apply these duties will depend on the outcome of the full investigation. “By the end of the year, the conclusions of the double investigation will be shared with all relevant stakeholders. After approval, the European Commission will announce its final decision on whether to impose countervailing duties before December 5,†said an official.
The EU's anti-dumping and countervailing investigations against Chinese solar products began on November 8, 2012. A temporary anti-dumping duty of 11.8% was applied to Chinese photovoltaic products starting June 6. If no compromise is reached by August 6, the rate could rise to 47.6%. Last month, the European Commission stated that a "friendly solution" had been reached between the EU and China regarding the PV trade dispute, which was welcomed by the Chinese Ministry of Commerce and most local PV companies.
EU Trade Commissioner Cecilia Malmström noted that a significant number of Chinese PV companies have agreed to set a minimum export price for their products sold in the EU. These companies represent about 70% of China’s total PV exports to Europe and will not be subject to punitive tariffs. Meanwhile, those that did not join the agreement will face a 47.6% anti-dumping duty.
The Sino-European PV trade dispute marks one of the largest trade conflicts in the history of Sino-European relations and remains a key issue in the broader context of China-EU economic and trade interactions.
