On the same day, the European Commission also confirmed that no temporary countervailing duties will be imposed on Chinese solar cell products. However, it emphasized that the final decision on whether to impose such duties will depend on the outcome of the full investigation. “At the end of the year, the findings of the double investigation will be shared with all relevant stakeholders,†said the Commission. “Once these groups approve the conclusions, the European Commission will announce its final decision on whether to impose countervailing duties before December 5.â€
The EU’s anti-dumping and countervailing investigations against Chinese solar products began on November 8, 2012. A temporary anti-dumping duty of 11.8% was applied to Chinese photovoltaic products starting June 6. If no compromise is reached by August 6, the duty could rise to 47.6%. Last month, the European Commission announced that China and the EU had reached a “friendly solution†to the PV trade dispute. This development was welcomed by the Chinese Ministry of Commerce and most Chinese PV manufacturers.
EU Trade Commissioner Cecilia Malmström stated that a significant number of Chinese PV companies have agreed to set a minimum export price for their products sold in the EU. These companies represent approximately 70% of China’s total PV exports to Europe. As a result, they will not be required to pay the punitive tariffs. However, companies that did not participate in the agreement will face an anti-dumping duty of 47.6%.
